Miss Haley alleged that passing the 150 metres in Race 1 Mr Edge used his whip free of the rein.
Miss Haley had Mr McIntyre demonstrate the incident on the videos. The Respondent gathered the reins in one hand and struck his horse, EDGE SHEERAN, once with the whip free of the rein.
Mr Edge said it was clear from the videos that was what he had done.
Decision
As Mr Edge has admitted the breach, it is found to be proved.
 Submissions as to penalty
Miss Haley produced the Respondent’s record which showed 222 lifetime drives. Mr Edge had 15 drives last season and one this season. His record was clear under the Whip Rule. She submitted the breach was very low end and a penalty in accordance with the Penalty Guide was appropriate.
Mr Edge did not disagree with Miss Haley.
Reasons for penalty
The breach is low end. The Penalty Guide provides for a fine in the range of $200 to $400 for a first such breach.
Conclusion
Mr Edge is fined the sum of $200.
