Evidence:
Following the running of Race 4, the Respondent admitted a charge of excessive whip use which was filed pursuant to Rule 638(3)(g)(i). Details are as follows:
“struck her mount “SAILOR JACK” 6 times prior to the 100 metres”
The Respondent acknowledged that she understood the Rule and admitted the breach. This was confirmed by Ms Clapperton.
Rule 638(3)(g)(i) provides that a rider must not
“strike a horse with a whip more than 5 times prior to the 100-metre (other than in a slapping motion down the shoulder with the whip hand remaining on the reins)”
Using available film, the Stewards identified that the Respondent struck her mount on 6 occasions prior to the 100 metre mark. The Respondent confirmed that she agreed with the count but did not specifically comment beyond this.
Decision:
As Ms Schofer admitted the breach, the Adjudicative Committee found the breach proved.
Submissions for Penalty:
Mr Goodwin outlined Ms Schofer’s record (under this Rule) within the last six months. Noted was a breach on 26th May 2022 – Otaki – 6 strikes ($250 fine). The Adjudicative Committee was referred to the current Penalty Guideline. Same provides for a fine of $250 in circumstances of 1 additional strike, second offence.
Reasons for Penalty:
The Adjudicative Committee considered evidence and submissions. The number of strikes, as alleged, were clearly demonstrated. There was no compelling reason found to depart from the current Penalty Guideline. As such a $250 fine is imposed.
Conclusion:
The Respondent, Ms Schofer is fined $250.
