SUMMARY OF FACTS:

Following the running of Race 7, the Gartshore Tauranga Stakes, Mr Davidson presented an Information charging Ms Schofer with a breach of Rule 638(3)(g)(i) in that she struck her mount TAVI MAC with her whip more than 5 times prior to the 100 metre mark.

The Committee records that, as an Apprentice Rider, Ms Schofer was “entitled” under Rule 916(2) to have her employer or mentor present to “safeguard her interests”; she wished to leave the racecourse and chose not to have any such assistance.

SUBMISSIONS:

The race film disclosed that Ms Schofer struck TAVI MAC – who was in contention – with the whip 6 times prior to the 100 metre mark.

REASON FOR DECISION:

As Ms Schofer admitted the charge, it was deemed proved.

SUBMISSION FOR PENALTY:

Mr Davidson advised that, within the reset period, Ms Schofer has had one previous breach of this Rule after which she was fined $400. He said the Guideline for a second breach being the greater of a fine of $500 (or 50% of the Jockey share of stake – which was not applicable) was sought.  Although this was a Black Type race he did not seek any increase in penalty through a suspension given that the strikes were well apart, not unduly excessive, and just one more than prescribed by the Rule.

Ms Schofer made no submissions as to penalty.

REASON FOR PENALTY:

Given the submissions of the Informant, a fine of $500 is imposed on Ms Schofer.  Any further breaches of the Rule must, in terms of the Guide, bring suspensions.

CONCLUSIONS:

Apprentice Hazel Schofer is fined $500.
