FACTS:

Trainer D Howard admitted a charge that as the Trainer of NEW ORLEANS JAZZ, he saddled the horse up minus the towel resulting in Jockey Mudhoo weighing in 0.7 kilos light. The horse, as stated in the Rules, was disqualified for the breach.

EVIDENCE:

Trainer D Howard informed the Adjudicative Committee he placed a black towel of his on top of a black towel belonging to the Jockey on the saddle and inadvertently picked up both towels. He said it was his mistake, the first time it had happened in his long involvement in the Racing Industry.

DECISION:

As the charge was admitted, it was deemed proved.

REASON FOR PENALTY:

The charge was admitted and the horse disqualified under the Rules. The connections of the horse, because of the disqualification, forfeited $280 for finishing 5TH. It was determined that the monetary penalty imposed should exceed that amount.

CONCLUSION:

Trainer D Howard was fined $300.
