Outcome: Proved

Penalty: Apprentice Jockey Roopesh Jaun is suspended for 4 days

Mr Davidson alleged that Mr Jaun rode carelessly in Race 7 when he shifted ground outwards passing the 250 metres, when not sufficiently clear.

Miss Haley demonstrated on the videos that Mr Jaun was racing back of midfield, one-off the fence, when he shifted ground outwards checking Mr INTELLIGENCE. He clipped a heel of that horse which dipped. Mr Jaun was not his length and another clear. Mr Davidson said Mr Jaun did look, but Mr Mudhoo was progressing forward quickly at the time.

Mr Laking agreed with Mr Davidson’s assessment. He added that Mr Jaun had just started riding and was inexperienced. He believed the Respondent was surprised in that GO LOTTE had responded better than he had anticipated. There was only half a stride in it.

Mr Jaun agreed with what Mr Laking had said.

Decision

As Mr Jaun has admitted the breach, it is found to be proved.

Submissions for Penalty

Mr Davidson produced the Respondent’s record. This was Mr Jaun’s first breach of the Rules. He said Mr Jaun had had 27 rides and had ridden one winner and was just beaten by a nose in this race. He described the breach as low range.

Mr Laking agreed the breach was low end. It was a misjudgement by Mr Jaun.

Mr Jaun stated he wished the suspension to commence immediately.

Reasons for Penalty

Mr Jaun has shifted ground outwards when not clear of Mr Mudhoo, whose mount was improving quickly. Mr Mudhoo’s mount has dipped as a result of touching a heel. He is an inexperienced Rider who has made a misjudgement. This is his first breach of the Careless Riding Rule. It is a low range breach and from a 5-day starting point, there is a one-day reduction for admission of the breach and good record.

Conclusion

Mr Jaun is suspended from the end of racing today, up to and including 15 October. This is 4 national days.
