EVIDENCE:

Following the running of Race 2 the Hirepool 1600, Senior Stipendiary Steward Mr M Williamson presented an Information alleging that Mr Goindasamy riding SAINT ALICE, breached Rule 638(3)(b)(ii) in that he used his whip excessively before the 100 metre mark.

SUBMISSIONS:

The facts, as illustrated by the raceday films by Mr A Dooley, showed that Mr Goindasamy struck his mount 6 times prior to the 100 metre mark.  Mr Goindasamy agreed with that interpretation.

REASON FOR DECISION:

Mr Goindasamy admitted the breach and it is deemed proved.

SUBMISSION FOR PENALTY:

Mr Williamson advised that Mr Goindasamy had not had any convictions for similar offending in the past 12 months, although he had received 7 warnings.

REASON FOR PENALTY:

In line with the NZTR Guide, a fine of $300 is imposed.

CONCLUSIONS:

Mr Goindasamy is fined $300.
