Penalty: Trainer Ken Duncan is fined $200

Following Race 3 Mr K Duncan was charged with a breach of Rule 613(d) in that he presented ZEDBRA with non-approved racing plates requiring the horse to be scratched.

Mr Goodwin said the error was picked up by the RIB Steward prior to the race at the time of the plate inspection. As a result ZEDBRA was a late scratching.

Mr Duncan was at a loss to explain how the error happened. He stated that the Farrier came to his property on Tuesday and attended to 5 horses including ZEDBRA. He said he would be speaking to his staff when he got home but could only surmise that the Farrier had made an error and applied working shoes instead of racing plates.

SUBMISSIONS FOR PENALTY

Mr Goodwin submitted a fine of $150 – $200 which was in accordance with previous breaches of the same Rule.

REASONS FOR PENALTY

In coming to a decision on penalty the Adjudicative Committee took into account all the circumstances that led to the error, and was of the opinion that a $200 fine is an appropriate penalty.

CONCLUSION

Mr Duncan is fined $200.
