Evidence:

Following the running of Race 4, the “Wanganui Function Centre Maiden 3YO”, Mr Goodwin presented an Information charging Ms Hercock, the Rider of “PROMETHEUS”, with careless riding in breach of Rule 638(1)(d).  He alleged that she allowed her mount to shift outwards near the 1000 metre mark when insufficiently clear of “SATSUKI” (Ms L Hemi), hampering in and consequently it was checked.

Ms Hercock admitted the breach.

The race film illustrated that “SIDE PIECE”, ridden by Mr C Dell, pressed forward from its wide draw to take the lead at the 1000 metre mark and immediately slowed the pace of the race, being immediately ahead of Ms Hercock’s mount.  She endeavoured to move around Mr Dell’s mount, but in doing so, hampered Ms Hemi’s mount as it was insufficiently clear.

Ms Hercock explained that she only moved outward because of the sudden slowing of the pace by Mr Dell, but accepted that she erred in doing so, rather than staying behind Mr Dell and slowing as he did.

Decision:

As the charge was admitted, it was deemed proved.

Submissions for Penalty:

Mr Goodwin advised that Ms Hercock has an excellent riding record – over 642 rides in the past 12 months, and no suspensions since September 2023.  The degree of carelessness was assessed as low.

Reasons for Penalty:

From a Guide starting point of 5 days suspension, an allowance of 1 day is given because of the Rider’s record and the very low degree of error when placed behind the abrupt slowing of pace.

Conclusion:

Ms Hercock’s Licence to ride is suspended from the conclusion of Racing at Otaki on 13 April 2024 until the conclusion of racing at Matamata on 19 April 2024 (4 days).
