FACTS:

Following Race 1 Information A15556 was filed with the Adjudicative Committee.

It was alleged by the Informant that Ms J Fawcett Rider of “SHOW ME THE MONEY” permitted her mount to shift inwards near the 325m when not clear of “DANCING DREAM” (K Hannan) which was checked.

Ms Fawcett said that she understood the Rule, charge and confirmed that she denied the charge.

SUBMISSION FOR DECISION:

In answer to questions from the Applicant, Ms Hannan said that her mount travelled well and railed well.  She added that near the interference point her mount changed stride to the inside leg.  She said Ms Fawcett then improved onto her and that her mount became unbalanced and that she had to check her mount.  She said that she called to Ms Fawcett two strides before contact was made.

Answering questions from Ms Fawcett, Ms Hannan said that she had her whip in her left hand while slapping her mount.  Ms Hannan said that her mount had run wide at the trials and had run off in trackwork.

All films were shown with both parties stating their interpretation on what had occurred.

SUMMATION:

Mr Goodwin said that before the incident Ms Fawcett was racing outside of Ms Allpress who was leading.  He then said that a little further on Ms Fawcett was directly behind Ms Allpress.  He said that she had allowed her mount to shift in and check Ms Hannan.

Ms Fawcett responded by saying she (Ms Hannan) runs out and turns my horse sideways and that Ms Hannan’s mount continued to run out from there on.  She added that she had no intention of riding behind Ms Allpress.  She said that it was a green horse and Rider that turned her sideways and that she did not cross Ms Hannan’s line and that she was always in a one-off position.  Ms Fawcett said that it was an error by Ms Hannan.

REASONS FOR DECISION:

The Adjudicative Committee considered  all the evidence presented and found that near the 325m “DANCING DREAM” was in some trouble and checked.

With the absence of a direct head-on film view, the Adjudicative Committee was of the opinion that shortly prior to the incident Ms Hannan’s mount, when changing stride, may have brushed  the running rail and stepped out momentarily and touched the rear end of Ms Fawcett’s mount, who then shifted in marginally.

Ms Fawcett was adamant that Ms Hannan’s mount shifted out onto her and that she did not allow her mount to shift in.  She added that it was due to a green horse and Rider that turned her sideways and maintained that she was always in a one-off position and did not cross Ms Hannan’s line.

After careful consideration of all matters put before the Adjudicative Committee, the Adjudicative Committee was not satisfied that Ms Fawcett had ridden carelessly.

In reaching this determination the Adjudicative Committee also considered that the horses were green two year olds which may have been a contributing factor.

DECISION:

The careless riding charge preferred against Licensed Jockey Ms J Fawcett was dismissed.
