Evidence:

Following the running of Race 5, the “Mr Swabby Wants a Sample Maiden 1600”, Mr N Goodwin presented an Information charging Mr Dell with a breach of Rule 638(3)(g)(ii) – the Whip Rule – in that he used his whip on his mount “JUSTIFY THAT” in 2 consecutive strides near the 150 metre point in the home straight.

Mr Dell admitted the charge.

The race films illustrated the breach.  Mr Dell’s mount was challenging for a place and eventually finished 4th (a neck and 3/4 length from 2nd) and was struck twice in consecutive strides in the last 150 metres.  Mr Dell frankly accepted his error.

Decision:

As the charge was admitted, it was deemed to be proved.

Submissions for Penalty:

Mr Goodwin advised that Mr Dell had no previous sanctions for such a breach (he had only been warned once).

Mr Dell accepted he was required to be fined.

Reasons for Penalty:

Adopting the Penalty Guide, the Adjudicative Committee fixed a penalty of a fine of $150, which Mr Dell acknowledged was appropriate.

Conclusion:

Mr Dell is fined $150.
