FACTS

Jockey T Bau admitted a charge of careless riding in that he allowed his mount MARTINA DIVA to move in when not clear of FLERTA and UNSCRIPTED near the 1150 mark. The film of the incident was shown and Stipendiary Steward N Goodwin pointed out that in coming across sharply, Jockey T Bau caused tightening to the horses on his inside. Jockey D Bradley riding FLERTA, had to take hold and restrain his mount. Jockey C Dell the Rider of UNSCRIPTED, also had to take hold of his mount. In answer to a question from the Adjudicative Committee, he agreed he was not the required distance clear when crossing, but felt Jockey C Dell over reacted.

DECISION

As the charge was admitted, it was deemed proved.

SUBMISSIONS ON PENALTY

The Stipendiary Stewards pointed out that this was Jockey T Bau’s first breach of this Rule. He rode only occasionally but they viewed the breach to be in the medium to low range. Jockey T Bau had nothing to add re penalty and did not wish to take any deferment.

REASON FOR PENALTY

Jockey T Bau was not the required distance clear when crossing, resulting in at least 2 horses being inconvenienced.

The Adjudicative Committee viewed the incident to be mid range. At least two horses were affected by the sharp movement across.

A starting point of 7 days was reduced to 6 days to reflect Jockey T Bau’s record and his admittance of the breach.

CONCLUSION

Jockey T Bau was suspended from race riding after today, the 6th of November, until the completion of racing on Tuesday the 15th of November.
