Background:
Following the running of Race 4, the ‘Cambridge Equine Hospital 2400’, an Information was lodged alleging a breach of Rule 638(3)(g)(i).
Details of the breach are as follows:
‘in that he struck his mount ‘Savacat’ nine times prior to the 100 metres’.
Mr Cameron confirmed to the Adjudicative Committee that he understood the Rule and admitted the breach.
Rule 638(3)(g)(i) provides that in a Flat Race a Rider must not:
(i) except as provided for in (iii) (A),(B) of this sub rule, strike a horse with a whip more than 5 times prior to the 100 metre mark (other than in a slapping motion down the shoulder with the whip hand remaining on the reins);
Evidence:
Using available film, Stewards identified the incident. From the top of the straight to the 100 metre mark, Mr Cameron is seen to strike his mount on 9 occasions. His mount is struck on 5Â further occasions between the 100 metre mark and finish line. SAVACAT finished 2nd in the event. Mr Cameron confirmed that he agreed with the Stewards’ interpretation and count.
Decision:
As the Respondent admitted the breach, the Adjudicative Committee found the breach proved.
Submissions for Penalty:
Stewards advised that the Respondent retained a clear record as it related to any breach of this particular Rule within the last 6 months. The Adjudicative Committee was referred to the current NZTR Penalty Guide. Despite having riding commitments at Ruakaka on 1st of May 2024, Mr Cameron requested that any suspension imposed, commence immediately.
Reasons for Penalty:
The breach is clearly identified by film. The current NZTR Penalty Guide provides for, in circumstance of 1st offence, 4 or more additional strikes, a starting point of a 5 day suspension. After consideration of all pertinent matters, a 5 NR day suspension was adopted as the appropriate sanction. Given that Mr Cameron had declared riding engagements at Ruakaka, his request to have any suspension commence immediately, was declined.
Conclusion:
The Respondent’s Licence to ride in races is suspended for 5 National Riding Days, with suspension to take effect from the close of racing on 1st of May 2024, up to and including 8th of May 2024.
