Outcome: Proved

Penalty: Jockey Opie Bosson is fined $500

Mr Oatham alleged that in Race 9,  Mr Bosson weighed in, 0.5 kgs over the weight at which he weighed out at.

This breach would normally be dealt with by way of a Minor Infringement, but it was placed before the Adjudicative Committee, due to the Group 1 status of the race.

Mr Oatham explained Mr Bosson was carded to ride CAMPIONESSA at 57kgs. He weighed out prior to the race at 57.3 kgs, but weighed in after winning the race at 57.8 kgs. Once a Rider weighs in .5kg over, they can be charged with a breach of the Rule. CAMPIONESSA finished in 4th place, by a margin of a short head.

Decision:

As Mr Bosson has admitted the breach, it is found to be proved.

Submissions for Penalty:

Mr Oatham said Mr Bosson breached the same Rule in January 2024, on QUINTESSA in the Levin Clasic Group 1 and was fined $500. The Stewards’ submission was for a monetary penalty in the $300 – $500 range.

Mr Bosson had no comment.

Reasons for Penalty:

The Adjudicative Committee considered all submissions and noted that a breach of this nature would typically fall under the Minor Infringement scheme, resulting in a $200 fine. While Mr Bosson has previous breaches of this Rule, they fall outside the 120-day reset period. However, given the Group 1 status of the race, the Adjudicative Committee deemed it appropriate to increase the fine, setting the total at $500.

Conclusion:

Mr Bosson is fined the sum of $500.
