Penalty: Apprentice Jockey Niranjan Parmar, suspended 2 days and fined $800

Evidence

Following the running of Race 9, the Respondent N Parmar (Apprentice Rider), admitted a charge alleging excessive whip use prior to the 100 metres.

Apprentice Mentor Noel Harris was present to assist.

Rule 638(3)(g)(i) provides that in a Flat Race a Rider must not:

(i) strike a horse with a whip more than 5 times prior to the 100-metre mark (other than in a slapping motion down the shoulder with the whip hand remaining on the reins); or

Using the available race films, Mr Oatham demonstrated that the Respondent struck his mount 6 times from the straight entrance to the 100-metre mark.

In relation to the incident, Mr Parmar had no comment.

Decision

As the Respondent, N Parmar admitted the breach, the Adjudicative Committee finds the breach proved (Rule 915(1)(d) refers).

Submissions For Penalty

Mr Oatham produced Mr Parmar’s record which indicated 3 previous breaches:

17th of December which was a $500 fine (the 3rd breach within 6 months)

4/3/23   $300 fine

4/3/23   $500 fine

Stewards assessed the breach as low and submitted a penalty commensurate with the NZTR Revised Penalty Guide for excessive whip use (as of 1 March 2022). Mr Oatham also added that Mr Parmar went on to win the race and that could be considered an aggravating factor.

The Respondent N Parmar sought a deferment to any proposed suspension until after the 8th of March 2023.

Reasons For Penalty

The Penalty Guide starting point for a breach of this nature is a 2 day suspension and a $500 fine.

The Adjudicative Committee expressed some concern that Mr Parmar had breached the same Rule 3 times within the same day and suggested to Mr Harris (Apprentice Mentor) that if the Stipendiary Stewards saw fit, they could recommend Mr Parmar back to the Rider Skills Review Panel for training purposes.

After considering the film evidence, the submissions and having due regard for the number and frequency of strikes and the force used; the Adjudicative Committee determined that an uplift from the starting point was appropriate.

Conclusion

The Respondent N Parmar’s request for a deferment is granted and his licence to ride in races is suspended for a period of 2 days, commencing after racing on 8th March 2023 and concluding after racing on 10th March 2023.

In addition to the suspension, an $800 fine is imposed.
