Evidence

Following the running of Race 8, the Respondent, A Adkins admitted a charge alleging excessive whip use prior to the 100 metres.

Rule 638(3)(g)(i) provides that in a Flat Race a Rider must not:

(i) strike a horse with a whip more than 5 times prior to the 100-metre mark (other than in a slapping motion down the shoulder with the whip hand remaining on the reins); or

Using the available race films, Mr Oatham demonstrated that the Respondent struck his mount 7 times from the straight entrance to the 100-metre mark.

In relation to the incident, Mr Adkins said he mistook the 200m for the 100m.

Decision

As the Respondent A Adkins admitted the breach, the Adjudicative Committee finds the breach proved (Rule 915(1)(d) refers).

Submissions For Penalty

Mr Oatham said that any visiting Riders were treated as having a clear record in NZ.

Stewards assessed the breach as low and submitted a penalty commensurate with the NZTR Revised Penalty Guide for excessive whip use (as of 1 March 2022).  Mr Oatham said that the breach had occurred in the NZ Derby and despite being unplaced, Mr Adkins’ Jockey’s percentage from stake earnings was $250.

The Respondent A Adkins, said it was his first time riding in NZ, and 7 strikes back in Australia would be normal.

Reasons For Penalty

The Penalty Guide starting point for a breach of this nature is $250.

After considering the film evidence, the submissions and having due regard for the number and frequency of strikes, the force used and the status of the race; the Adjudicative Committee determined a small uplift from the starting point was appropriate.

Conclusion

The Respondent A Adkins is fined $350.
