Penalty: Apprentice Jockey, Niranjan Parmar fined $250

Evidence:

Following the running of Race 5, Information A14178 was lodged alleging the Respondent, Apprentice Rider Mr Parmar, struck his mount six times prior to the 100-metre mark. Particulars of the charge are that:

“…he struck his mount 6 times prior to the 100 metres”.

Mr Parmar confirmed to the Adjudicative Committee that he admitted the breach. He was assisted at the hearing by Senior Rider, Mr D Danis.

Rule 639(3)(g)(i) provides that a rider must not:

“strike a horse with a whip more than 5 times prior to the 100-metre mark (other than in a slapping motion down the shoulder with the whip hand remaining on the reins)

Using the available race film Stewards demonstrated that the Respondent struck his mount six times between the top of the straight and the 100-metre mark.

In response Mr Parmar said that he agreed with the count. He added that he miscounted the number of strikes.

Decision:

As the Respondent admitted the breach the Adjudicative Committee finds the breach proved.

Submissions for Penalty:

Stewards presented the Respondent’s record which indicated one previous breach of this Rule within the last 6 months, namely on 30th July 2022 – 6 strikes.

A penalty in line with current Guidelines was recommended.

Reasons for Penalty:

The current Penalty Guidelines provide for a fine of $250 for a second breach of the Rule, in circumstances of one additional strike (6). The Adjudicative Committee found no reason to depart from this Guideline.

Conclusion:

The Respondent Mr Parmar is fined $250.
