Evidence:

Following the running of Race 5, the KEN AND ROGER BROWNE MEMORIAL MAIDEN STEEPLECHASE, Mr Jones presented an Information charging Mr Phelan with a breach of Rule 638(2) in that he made a celebratory gesture prior to the his horse, “THE COSSACK” passing the winning post.

The race film demonstrated that Mr Phelan when riding “THE COSSACK” which was well clear – and won the race easily, commenced to make extravagant celebratory gestures at least 50 metres before the finish of the race.

Decision:

As Mr Phelan admitted the breach, it was deemed proved.

Submissions for Penalty:

Mr Phelan had a previous breach of this Rule on 3 October 2021 at Te Aroha for which he was fined $200.

Mr Phelan’s excuse – if such it could be called was that his mount was “a unique horse” and, although an “easy maiden race”, jumps racing deserved that such celebrations be “marked”.

Reasons for Penalty:

The Rule is required to meet safety standards and it applies whether the race is a black type, or maiden race.  Given the previous breach within 12 months, Mr Phelan is fined $300.

Conclusion:

Jockey Shaun Phelan is fined $300.
