Penalty: Jockey Doni Prastiyou is fined $250

Evidence:

Following the running of Race 2, the “Power Family – We Love Farmers 2400”, Mr Dooley presented an Information charging Mr Prastiyou with a breach of the Whip Rules, Rule 638(3)(g)(i), in that he struck his mount, “HERE’S JOHNNY”, six times with his whip prior to the 100 metre mark.

Mr Prastiyou admitted the breach.

The race film revealed that when racing midfield from the 400 metre point and prior to the 100 metre point, “HERE’S JOHNNY” was struck with the whip by Mr Prastiyou, six times, being one more than permitted.

Mr Prastiyou said that he “thought” he had not reached the 100 metre mark, but knew he had struck the horse more times than permitted.

Decision:

As the breach was admitted, it was deemed proved.

Submissions for Penalty:

Mr Dooley advised that Mr Prastiyou had received a warning 2 weeks ago on 1 April 2023, for a breach of the Rule, and relied on the Penalty Guide which referred to a starting point of a fine of $250.

Mr Prastiyou said he would prefer to receive a suspension and accepted that he should be fined.

Reasons for Penalty:

Whilst the Penalty Guide is just that, and an Adjudicative Committee is required to exercise its own judgment depending upon all the circumstances, both aggravating and mitigating, there is no reason in this case for any departure from the Guide.

Conclusion:

Accordingly, Mr Prastiyou is fined $250.
