Evidence
Following the running of Race 7, the Respondent M Cartwright admitted a charge alleging excessive whip use prior to the 100 metres.
Rule 638(3)(g)(i) provides that in a Flat Race a Rider must not:
(i) strike a horse with a whip more than 5 times prior to the 100-metre mark (other than in a slapping motion down the shoulder with the whip hand remaining on the reins); or
Using the available race films, Mr Jones demonstrated that the Respondent struck his mount 8 times from the straight entrance to the 100-metre mark. He said Mr Cartwright struck his mount a further 3 times inside the last 100m (a total of 11 strikes).
In response, the Respondent said while he knew what the NZ Rule was in regard to whip use, he was still becoming accustomed to it due to the fact he had previously ridden in Australia. He added that the Australian Whip Rule was quite different.
Decision
As the Respondent M Cartwright admitted the breach, the Adjudicative Committee finds the breach proved (Rule 915(1)(d) refers).
Submissions for Penalty
Mr Jones produced the Respondent’s New Zealand record which was clear; Mr Cartwright has only just begun riding in New Zealand. He said the Adjudicative Committee may wish to consider the fact that Mr Cartwright won the race by a long neck.
Stewards submitted a penalty commensurate with the NZTR Revised Penalty Guide for excessive whip use (as of 1 March 2022).
The Respondent had nothing further to add.
Reasons for Penalty
The Penalty Guide starting point for a breach of this nature is a $500 fine.
After considering the film evidence, the submissions and having due regard for the number and frequency of strikes and the force used, the Adjudicative Committee determined there are no compelling reasons to depart from the starting point set out in the Penalty Guide.
On that basis, the Respondent is fined $500.
Conclusion
Jockey M Cartwright is fined $500.
