FACTS

Ms Balle the Driver of “LILLIBURLERO” admitted a breach of Rule 869(3)(b).

It was alleged that near the 600m Ms Balle allowed her drive to contact the outside sulky wheel of “JOHN WAYNE” which was punctured.

Ms Balle said that she understood the Rule, Charge and confirmed that she admitted the breach.

Mr Mulcay showed film replays and pointed out where contact with the wheel was made.

Ms Balle and Mr Balle agreed with Mr Mulcay.

DECISION

As the charge was admitted it was deemed proved.

PENALTY SUBMISSIONS

Mr Mulcay said Ms Balle is a relatively inexperienced Junior Driver with a clear record.

He said an aggravating factor was that the chances of “JOHN WAYNE” were affected as the horse took no further competitive part in the Race, as the tube came adrift from the tyre.

Mr Balle said that it was a minor error on the part of Ms Balle as her horse would have missed the wheel if it had been back a few millimetres.

REASONS FOR PENALTY

Taking into account all matters in relation to penalty, a fine of $200 was appropriate.

CONCLUSION

Ms Balle was fined $200.
