FACTS:
Mr Ferguson (HOLYROOD) admitted a breach of using his whip with more than a wrist flicking motion in the early and latter stages of the race.
Mr Ferguson said that he understood the Rule, charge and confirmed that he admitted the breach.
Film replays were shown which clearly showed Mr Ferguson using his whip as was alleged per Information A16157.
DECISION:
As the charge was admitted it was deemed proved.
PENALTY SUBMISSIONS:
Mr Mulcay said that Mr Ferguson had a clear record and that the breach was low-level.
The starting point was referred to.
REASONS FOR PENALTY:
Due to the clear record, a fine of $200 was considered to be a suitable penalty.
CONCLUSION:
Mr Ferguson was fined $200.
