FACTS:

An Information was filed pursuant to Rule 870(3) Instigating a Protest alleging that SONSOFTHEMERCH (Z Butcher) galloped in excess of 50m in the last 200m.

The Judge’s placings were:

1st        8          MONT BLANC

2nd      1          QUIK SHARNIE

3rd       7          PLAY FOOTSIE

4th      10        SONSOFTHEMERCH

5th       4          HUGHIE WALLACE

SUBMISSIONS FOR DECISION:

Mr Mulcay showed film replays and identified where SONSOFTHEMERCH had galloped in excess of 50m over the final 200m without going back to its trotting gait.

Mr Hall the Trainer agreed with the Stipendiary Steward’s interpretation.

REASONS FOR DECISION:

The Adjudicative Committee was satisfied that SONSOFTHEMERCH had galloped for more than 50m inside the final 200m of the race.

DECISION:

SONSOFTHEMERCH was disqualified with the Protest being upheld.

3rd      7          PLAY FOOTSIE
