Penalty: PRESIDENTS TOPSHOT is disqualified from the race
Following the running of the WEDNESDAY QUIZ NIGHT AT THE CLUBHOUSE TROT an Information instigating a Protest was lodged by Stipendiary Steward Mr Adrian Dooley against the 5th placing of PRESIDENTS TOPSHOT on the grounds that it broke from its gait approaching the 100 metres mark and galloped in excess of 50 metres before settling.
Rule 870(3) provides:Â that any horse that breaks from its gait during the running shall promptly return to its correct gait.
The Breaking Horses Regulations provide:Â that any horse which breaks from its gait in the last 200 metres and gallops in excess of 50 metres shall be in breach of Rule 870(3) and shall be disqualified by the Adjudicative Committee.
Mr O Gillies the Trainer of PRESIDENTS TOPSHOT was present at the hearing and he advised the Adjudicative Committee that he did not contest the Protest.
Mr Dooley demonstrated the incident by use of the race films and he identified PRESIDENTS TOPSHOT and showed where it broke with about 125 metres to run and galloped to just short of the finishing line.
DECISION:
The Protest is not contested and is therefore upheld. PRESIDENTS TOPSHOT is disqualified from the race.
The amended placings are:
first (1) SHARE THE LOVE
second (4) MONT BLANC
third (7) ULTIMATE MOMENT
fourth (3) DEBBIE LEE GALLEON
It was ordered that dividends and stakes be paid in accordance with the amended placings.
