Penalty: Driver Mark Purdon is fined $300

Following the running of THE RACE BY GRINS MOBILE PACE, an Information was lodged by Chairman of Stewards Mr N McIntyre, against Driver Mr M Purdon alleging that Mr Purdon, as the Driver of SELF ASSURED, failed to maintain his position on the Mobile Barrier until dispatch.

Rule 858(1)(i) provides: A driver must not fail to maintain his or her position.

Mr Purdon was present at the hearing and he understood the Rule and admitted the breach.

Mr McIntyre demonstrated the incident by use of the race films and showed where prior to the start SELF ASSURED was about a length off the Barrier at dispatch.

Mr Purdon for his part, thought that he might have been only half a length back prior to dispatch.

DECISION:

The breach is admitted and accordingly the charge is proved.

PENALTY SUBMISSIONS:

Mr McIntyre said that Mr Purdon had a clear record under this Rule. He said that the Stewards would normally be looking for a $100 fine but in view of the stake and the status of the race a fine of $300 was appropriate.

Mr Purdon said he would be guided by the Adjudicative Committee as to penalty.

PENALTY REASONS:

The race films clearly show the start and in the Adjudicative Committee’s view SELF ASSURED is approximately one length back from the Barrier prior to dispatch.

This charge can be dealt with by way of a fine and because of the status of the race, the Adjudicative Committee concurs with Mr McIntyre in the amount of $300.

PENALTY DECISION:

Mr Purdon is therefore fined $300.
