FACTS:

Following Race 1, Information A16166 was filed with the Adjudicative Committee.

It was alleged that Mr Rich drove carelessly when contacting the sulky wheel of “MR WONDERFUL”, and as a result, “PACING HOPE” broke near the 600m, losing ground.

Mr Rich said that he understood the Rule, charge and confirmed that he admitted the breach.

Film replays were shown with Mr Mulcay showing where the incident took place.

Mr Rich said that “MR WONDERFUL” had shifted out a little and that when he went back, he misjudged and hit the outside wheel.

DECISION:

As the charge was admitted, it was deemed proved.

PENALTY SUBMISSIONS:

Mr Mulcay said that Mr Rich had a clear record and referred to the Penalty Guide.

Mr Rich reminded the Adjudicative Committee that he was an Amateur Driver.

REASONS FOR PENALTY:

Taking into account all matters including the Amateur Driver status, a fine less than the starting point was considered to be appropriate.

CONCLUSION:

Mr Rich was fined $150.
