SUMMARY OF FACTS:

Following Race 1, Brosnans Transport Ltd Passing Lane Trot, an Information instigating a protest was filed against 4th placing being awarded to VERTIGO (Lawrence McCormick) on the ground that it broke in excess of 50 metres over the concluding stages.

The Regulation provides that any horse which breaks from its gait within the final 200 metres of any race and continues on in the break for a distance of 50 metres or greater shall be disqualified from the race.

SUBMISSIONS:

Mr Munro showed a video replay of the final 100 metres of the race. He pointed out VERTIGO, driven by Mr McCormick, racing in 4th position at the time, go into a break, free of interference, with approximately 70 metres to run and continue on in a break to the finishing line.

VERTIGO finished in 4th placing and Mr Munro sought its disqualification.

REASON FOR DECISION:

The Committee was satisfied that VERTIGO had broken from its gait, free of interference, with approximately 70 metres to run and had continued in a break to the finishing line, in breach of the Breaking Horses Regulation.

Mr McCormick had endorsed the Information form indicating that he did not contest the protest.

CONCLUSIONS:

VERTIGO was disqualified from the race. Consequent upon the disqualification, the amended placings for the race are as follows:

1st   10  Jakarta

2nd  5   Kosciuszko

3rd   1   Barrytown

4th  15  Lookslikeatrixter

5th   8   Tyron Arohanui

It is ordered that dividends and stakes be paid in accordance with that amended result.
