EVIDENCE:
Following the running of Race 2, Stipendiary Steward Mr Paul Williams presented an Information alleging a breach of Rule 865(2) by Trainer Mr Robbie Holmes.
Mr Holmes stated he was conversant with the Rule, the Charge and confirmed he admitted the breach.
Mr Williams said this breach of the Rules is usually dealt with by way of the Min regime but as this is Mr Holmes’ third breach since July, an Information is presented.
Mr Williams stated Mr Holmes was fined $100 on 21 July 2023 and again on 6 August for incorrect gear.
Mr Holmes had nothing to add.
DECISION:
The Respondent having admitted the breach, the charge was deemed to be proved.
SUBMISSIONS FOR PENALTY:
Mr Williams said a fine in the vicinity of $200 would be appropriate.
Mr Holmes made no submissions.
REASONS FOR PENALTY:
The Adjudicative Committee in searching similar cases, found a third breach by Mr S Telfer in 2022, which resulted in a fine of $150 being imposed.
CONCLUSION:
Trainer Robbie Holmes is fined $150.
