SUMMARY OF FACTS

Following Race 7 Mr Jones filed an Information Requesting a Ruling by the Adjudicative Committee.  It was alleged that Mr Goindasamy the Rider of “SEMPRINI” weighed in 0.8kg under the handicapped weight including the Apprentice allowance.

The Applicant requested that “SEMPRINI” who finished 6th be Disqualified.

Rule 648(3) in part reads:

The Clerk of the Scales shall allow such Rider 0.5kg and if the Allowance is not sufficient to enable the proper weight to be drawn then subject to Sub Rule (4) of this Rule then in addition to any other penalty which may be imposed the horse shall be Disqualified for the Race.

SUBMISSIONS

Mr Goindasamy’s lead bag was produced which showed that the stitching on one of the pouches, which holds the lead, had come apart.  The lead bag was in relatively good order.

Mr Jones said that Ms Fursdon the Trainer of “SEMPRINI” had told the Stewards that the lead bag was in good order and that the pouch contained lead when saddling in preparation for the Race.

Ms Fursdon did not attend the hearing.

Mr Goindasamy said that his mount hit a fence when leaving the birdcage and that the lead bag may have been damaged at that time, with the lead falling out between that time and weighing in.

RULING

As Mr Goindasamy weighed in 0.8kg lighter than his weigh-out weight, the Adjudicative Committee acting pursuant to Rule 648(3) Disqualified “SEMPRINI”.
