Penalty: Apprentice Jockey Niranjan Parmar is fined $500

Evidence:

Following the running of Race 11 an Information was lodged alleging the Respondent struck his mount six times prior to the 100 metre mark. Details are as follows:

“In that he struck his mount 6 times prior to the 100 metres”.

Mr Parmar confirmed to the Adjudicative Committee that he admitted the breach.

Rule 639(3)(g)(i) provides that a rider must not:

“strike a horse with a whip more than 5 times prior to the 100 metre mark (other than in a slapping motion down the shoulder with the whip hand remaining on the reins)

Using available film Stewards demonstrated the Respondent struck his mount 6 times between the the top of the straight and the 100 metre mark. Mr Parmar did not offer comment beyond confirming that he agreed with the count.

Decision:

As the Respondent admitted the breach the Adjudicative Committee finds the breach proved.

Submissions for Penalty:

Stewards presented the Respondent’s record outlining 2 previous breaches of this Rule within the last 6 months, namely 23rd February 2022 – 7 strikes and 26th February 2022 – 6 strikes. A penalty in line with current Guidelines was recommended.

Reasons for Penalty:

Current Guidelines provide for a fine of $500 in circumstances of 1 additional strike (6) where same represents a 3rd offence within a 6 months period. The Adjudicative Committee found no reason to depart from this Guideline.

Conclusion:

The Respondent Mr Parmar is fined $500.
