EVIDENCE:

Following Race 1 Information A15519 was filed with the Adjudicator.  It was alleged that Mr Weatherley had allowed his mount “DOHA” to shift in when not clear of “RISCHIO” which clipped a heel and went off-stride.

Mr Weatherley said that he understood the Rule, Charge and confirmed that he admitted the breach.

SUBMISSIONS:

Film replays were shown with Mr Goodwin identifying both horses.  He said that with a round to travel “DOHA” who was 3-wide shifted in and that “RISCHIO” clipped a heel.

He said it was only for one stride and that Mr Weatherley had pulled off immediately.

He added that Mr Weatherley was a little unlucky and placed the carelessness at the low-end.

Mr Weatherley said that he did come across but only for one stride and pulled off straight away.

REASON FOR DECISION:

As the charge was admitted it was deemed proved.

SUBMISSION FOR PENALTY:

Mr Goodwin said that Mr Weatherley had 4 prior breaches in the last 12 months, but when considering the number of rides he has had it was a reasonable record.

Mr Weatherley said that he has had close to 800 rides in the last 12 months.

He asked for any suspension to start after 27 November.

REASON FOR PENALTY:

Taking into account that the careless riding was at the low-end as Mr Weatherley had almost cleared “RISCHIO” prior to it clipping a heel, plus the breach was admitted, the Committee determined that a 4-Riding Day Suspension was a suitable penalty.

The starting point of 5-Days Suspension would have included a Group 1 Day and it was the opinion of the Committee that the carelessness exhibited by Mr Weatherley did not justify such a sanction.

CONCLUSIONS:

Mr Weatherley’s Jockey’s Licence was suspended after Racing on 27 November up to and including Racing on 3 December 2021.
