Evidence:

Following the running of Race 2, an Information was presented by Stipendiary Steward Mr Shane Renault, by way of a Protest, alleging Number 8 in the race CIRCUS CIRCUS (John Dunn), had started out of its correct barrier position.

Stable representative Mr Nigel Armstrong was in attendance at the protest hearing and had signed on the Information form the connections of the horse did not contest the protest.

Mr Renault played the video replay of the start and identified CIRCUS CIRCUS who was drawn unruly 1 in the seven-horse field. He pointed to CIRCUS CIRCUS, who was fractious as the horses were called into line, and showed the horse reef and pull itself towards the barrier despite the efforts of Mr Dunn. When the barriers were released CIRCUS CIRCUS was not in its correct position.

Reasons for Decision:

It was clear to the Adjudicative Committee that through its own intractability, CIRCUS CIRCUS has started the race on the front line and possibly in advance of some of the field. It is of note CIRCUS CIRCUS galloped, paced, and galloped again and took no part in the race finishing in last place.

Decision:

The Adjudicative Committee disqualified CIRCUS CIRCUS from Race 2, and in the interest of the betting public to have their investments refunded, Mr Renault asked for the horse to be declared a late scratching which was implemented.
