EVIDENCE:
Following the running of Race 2, Stipendiary Steward Mr Matt Sole presented an Information alleging a breach of Rule 869(2) by Junior Driver Ms Alana Cameron.
Ms Cameron stated she was conversant with the Rule, understood the Charge and confirmed she admitted the breach.
Ms Cameron was assisted at the hearing by Senior Driver Mr John Dunn.
Mr Sole identified Ms Cameron racing in the 1×1 approaching the home straight. He pointed to Ms Cameron driving to the finish and striking her horse with more than a wrist flicking motion.
Mr Sole said the breach was over a relatively short period, but there was just too much action in her technique. He said Ms Cameron returned to a compliant style, going on to win the race comfortably.
Ms Cameron and Mr Dunn had nothing to add.
DECISION:
The Respondent having admitted the breach, the charge was deemed to be proved.
SUBMISSIONS FOR PENALTY:
Mr Sole stated Ms Cameron has had 3 previous breaches under the Rule within the last 6 months.
28 December 2022 at Westport – 3 days
30 December 2022 at Reefton – 3 days.
12 February at Hororata 2023 – 3 days
Mr Sole said the Stewards see this breach at low level, but it is Ms Cameron’s 4th and believe a 4-day suspension is warranted.
Ms Cameron made no submissions on Penalty but asked to have any suspension deferred for 7 days.
Mr Dunn asked the Adjudicative Committee to consider Ms Cameron’s status as a Junior Driver.
REASONS FOR PENALTY:
The Penalty Guidelines provide a 3-day suspension for a second or subsequent breach of the Rule at low level, which this is.
Mr Sole requested an uplift in penalty as this is Ms Cameron’s 4th breach of the Rule, but the Adjudicative Committee recognise two of Ms Cameron’s previous breaches are 7 days from exiting her record. A 3-day suspension under the circumstances of this case is considered a fair and reasonable sanction.
Deferment is granted.
CONCLUSION:
Junior Driver Ms Alana Cameron’s Licence to drive in races is suspended from the conclusion of racing on 28 May 2023, up to and including racing on 9 June 2023.
