EVIDENCE:
Following the running of Race 3, an Information was presented by Chairman of Stewards Mr Nigel McIntyre alleging a breach of Rule 869(2) by Driver Mr Colin DeFilippi which was admitted.
Mr McIntyre showed the final 200m of the Race and identified Mr DeFilippi (HERE’S HERBIE) contesting the lead in the centre of the track. He pointed to Mr DeFilippi turn his whip and strike his sulky free of the rein.
Mr DeFilippi said he wasn’t going to turn his whip but when the horse on the rail, (HEAVEN ON HIGH) the winner of the race, got clear and finished quickly it took him by surprise. He said the moment he struck his sulky with his whip he knew he had breached the Rule.
SUBMISSION FOR PENALTY:
Mr McIntyre said the breach was minor but Mr DeFilippi had been spoken to twice recently in relation to the Whip Regulations, hence the charge being put forward today. He said a fine of $200 was sought by the Stewards.
Mr DeFilippi made no submissions on Penalty.
REASON FOR PENALTY:
The Penalty Guidelines for a low-level breach is a fine of $200, mitigation inclusive, and the Adjudicative Committee considers this an appropriate Penalty in this case.
CONCLUSIONS:
Mr DeFilippi is fined $200.
