SUMMARY OF FACTS:

Following the running of Race 5 Stipendiary Steward, Mr Shane Renault presented an Information alleging a breach of Rule 857(7)(a) by Junior Driver Mr Korbyn Newman which was admitted. Mr Newman stated he was conversant with the Rule and was assisted in the hearing by Open Driver Mr Richard May.

EVIDENCE:

Mr Renault showed the video of the start and identified Mr Newman (CLASSIE WASHINGTON) drawn 6 of 7 as the field approached the barrier strand. He pointed to the outside horse GLASSY WEBB rear and back out of line. Mr Renault said despite the Starter’s order to stay in line Mr Newman turned his horse away delaying the start.

Mr Newman had no submissions.

Mr May said because GLASSY WEBB had backed out of line the start was going to be delayed anyway.

REASON FOR DECISION:

Mr Newman admitted the breach therefore the charge was deemed proved.

SUBMISSION FOR PENALTY:

Mr Renault said Mr Newman was an experienced Junior Driver having 354 drives this season. He said he has a good record but was warned under this Rule on 8th August. Mr Renault said the Rule carries a fine of $200 for an admitted plea, mitigation inclusive.

REASONS FOR PENALTY:

There are no factors present here to deviate from the Guidelines.

CONCLUSIONS:

Mr Newman is fined $200.
