Evidence
Following the running of Race 6, the Respondent, W Kennedy admitted a charge alleging use of whip above shoulder height near the 150m.
Rule638(3)(f)(ii) provides that in a Flat Race a Rider must not:
(ii) use an action that raises the rider’s arm above shoulder height.
Using the available Race films Stipendiary Steward, Mr Dooley demonstrated that the Respondent struck his mount once with an action raising his arm above shoulder height in the final straight . Mr Dooley also added that the horse to the inner of Mr Kennedy’s mount shied away from the whip, due to Mr Kennedy’s action.
Mr Kennedy had no comment in regard to the breach.
Decision
As the Respondent admitted the breach the Adjudicative Committee finds the breach proved (Rule 915(1)(d) refers).
Submissions For Penalty
Mr Dooley produced the Respondent’s record which indicated one previous breach, which was recorded as a warning. This had occurred on the 16th of September at Riccarton.
Stewards submitted a penalty commensurate with the NZTR Whip Penalty Guidelines of $250 was appropriate.
Mr Kennedy provided no comment on penalty.
Reasons For Penalty
The Penalty Guide starting point for a breach of this nature is $250.
The Committee saw no reason to deviate from the penalty guideline.
Conclusion
Mr Kennedy is fined $250.
