SUMMARY OF FACTS:

Following the running of Race 1, the Gartshore Interiors Maiden, Mr Davidson presented an Information charging Ms Fawcett, the Rider of SUPERPOMPIDIOUS with a breach of Rule 638(1)(d), in that she rode carelessly when entering the home straight.

SUBMISSIONS:

Mr Davidson illustrated the actions of Ms Fawcett from the race films which showed that about 350 metres prior to the finish Ms Fawcett allowed her mount to shift out onto and crowd the horse MOONLIGHT SHADOW when not sufficiently clear, making contact with that horse which in turn was forced onto the horse, EL BANDOLERO which was buffeted and unbalanced.

Ms Fawcett accepted that she erred in not being sufficiently clear of MOONLIGHT SHADOW but explained that she was hindered by poor visibility through water and mud on her riding goggles, and had become awkwardly placed on the heels of KWAUSSIE GIRL (ridden by Mr J Kamaruddin who was also moving slightly out.

REASON FOR DECISION:

Ms Fawcett admitted the breach and it is deemed proved.

SUBMISSION FOR PENALTY:

Mr Davidson advised that whilst Ms Fawcett had had 4 breaches of the Careless Riding Rule between January and May 2021, she had only one in the past 6 months.  She is due to serve a suspension for a breach of the Whip Rule after racing on Tuesday 19 November 2021 until the end of racing on 3 December 2021.

Ms Fawcett said she would prefer a fine to a further suspension.

REASON FOR PENALTY:

A fine is not an appropriate sanction for a low/midrange breach where there is another previous carless riding breach within the past 6 months.  A suspension of 5 National Riding Days is required and, if it is to have any effect, it is to commence at the conclusion of racing on 3 December 2021 and finish at the conclusion of racing on 11 December 2021.

CONCLUSIONS:

Jockey Jasmine Fawcett is suspended for 5 National Riding Days.
