FACTS
Following the running of Race 3, Ms Elen Nicholas, the Rider of ‘PHARAOH’S DREAM’, admitted a breach of careless riding. The careless riding being that, near the 300m, Ms Nicholas allowed her mount to shift outwards when not clear of ‘FLUTTERBELLE’ (K Hannan), which clipped a heel and blundered near the 300m.
Ms Nicholas, in the presence of Mr Noel Harris, said that she understood the Rule, charge and confirmed that she admitted the breach.
Film replays were shown which clearly showed ‘PHARAOH’S DREAM’ shifting out, with ‘FLUTTERBELLE’ clipping a heel.
DECISION
As the charge was admitted, it was deemed proved.
PENALTY SUBMISSIONS
Mr Jones said that Ms Nicholas had a clear record and had had 167 rides this season. He said that it was a gradual movement and placed the carelessness in the low to mid-range.
Mr Harris said that it was only a minor shift and that all Riders were shifting out for better ground.
REASONS FOR PENALTY
The Adjudicative Committee placed the carelessness in the low-range category and taking all matters into consideration, which included the excellent record, determined that a 4-riding day suspension was appropriate.
CONCLUSION
Ms E Nicholas’ Apprentice Jockey’s Licence was suspended from end of racing on 15 July, to 23 July 2023 inclusive.
