FACTS:

Mr L Innes the Rider of “UDERZO”, admitted a breach of Rule 638(1)(d) in that he permitted his mount to shift inwards when not sufficiently clear, crowding “SUPERIORITY” which was checked approaching the 100 metres.

Mr Innes advised the Adjudicative Committee that he understood the Rule, charge and confirmed that he admitted the breach.

Mr Oatham showed film replays and said that Mr Innes came in gradually and that Mr Pinn “AFTER PARTY” shifted out a little.  He added that Ms Grylls “SUPERIORITY” had to take a firm hold.  He added that Mr Innes continued his inward movement.

Mr Innes said that he was on a green horse, that Mr Pinn had shifted out and that Ms Grylls’ mount was fading quickly.

DECISION:

As the charge was admitted, together with the film evidence, it was deemed proved.

PENALTY SUBMISSIONS:

Mr Jones said that Mr Innes had 3 previous breaches of the Rule during the last 12 months.  He placed the careless riding in the low-range.

Mr Innes said that any suspension could start after 30 April 2022.

REASONS FOR PENALTY:

The Adjudicative Committee found that Mr Innes did shift in on a gradual movement.

Mr Pinn’s mount contributed to the interference by shifting outwards slightly.

The carelessness exhibited by Mr Innes was considered low-range.

The Penalty Guide starting point for low-range is a suspension of 5-Days.

Taking into account the admission of the breach, a discount of one day was given.

CONCLUSION:

Mr Innes’ Jockey’s Licence was suspended from end of racing on 30 April 2022 through to the cessation of racing on 6 May 2022 (4 Riding Days).
