Penalty: Jockey Joe Doyle is fined $250

BACKGROUND:

Following the running of Race 1, Mr Jones presented an Information charging Mr Doyle with a breach of Rule 638(3)(g)(i) in that he struck his mount ‘BUCCHERI” more than 5 times prior to the 100 metre mark.

EVIDENCE:

Mr Jones demonstrated from the race films that between the 500 metres and 100 metres marks, Mr Doyle, when leading, struck “BUCCHERI” 7 times with the whip.  The horse fought on to win the race.  This was Mr Doyle’s first ride in New Zealand, having had a very successful career as a Jockey in Ireland and Britain.

DECISION:

As the charge was admitted, it was deemed proved.

SUBMISSIONS FOR PENALTY:

Because the breach involved 2 strikes more than permitted, the outcome of a warning only for a first offence was not available.

The Penalty Guideline starting point is a fine of $250.

REASONS FOR PENALTY:

Although it might be seen as aggravating that “BUCCHERI” won the race, the Adjudicative Committee balances this with the mitigating factor that this was Mr Doyle’s first ride in New Zealand.

CONCLUSION:

Mr Doyle is fined $250.
