Evidence:
Following the running of Race the “Classic Building 1215” the Informant presented and Information Requesting a Ruling concerning the horse “TREASURE STATE” which finished 11th.

Submission for Decision:
The rider of the horse was Mr Yanagida who weighed out at 60kg, weighed in at 59.4kg – that is 0.6kg below the weight at which he weighed out and was beyond the 0.5kg allowed.

Rule 648 (3) provides “…that the Clerk of the Scales shall allow such rider 0.5kg and if the allowance is not sufficient to enable the proper weight to be drawn… the horse shall be disqualified from the Race”.

Of course, if the weigh in weight is in excess of that at which the Rider weighed out, a horse shall not be disqualified by that reason alone,

As the Owners and Trainers were not present on course, Mr Trumper attended on their behalf (and Mr Scott was later in the telephone contact) and accepted that the horse had to be disqualified as it did not earn a stake (payments were only back to 10th place) no financial loss arose for anyone.

Decision:
“TREASURE STATE” is disqualified from the race, the Classic Building 1215”.
