Evidence:

Following the running of Race 5, Information A17359 was lodged alleging the Respondent, Mr H Kamaruddin (MOHAWK BRAVE) used his whip excessively prior to the 100 metres.

Rule 638(3)(g)(i) provides that a rider must not:

“Strike a horse with a whip more than 5 times prior to the 100-metre mark (other than in a slapping motion down the shoulder with the whip hand remaining on the reins)

Mr Kamaruddin confirmed to the Adjudicative Committee that he understood the Rule and admitted the breach. Apprentice Mentor, Ms Kim Clapperton was present to assist.

Using the Race films Stewards identified Mr Kamaruddin in the Fortuna Colours racing on the outside of the field.  He struck his mount 8 times from the straight entrance to the 100-metre mark.

Mr Kamaruddin agreed with the number of strikes and had nothing further to add.

Decision:

As the Respondent admitted the breach the Adjudicative Committee finds the breach proved.

Submissions for Penalty:

Mr Goodwin said that Mr Kamaruddin commenced riding in New Zealand in November after moving from Singapore. He received a warning for excessive whip use on December 1st at Taranaki.

Mr Kamaruddin said there is no limit to the number of times a rider may use the whip in races in Singapore. Ms Clapperton sought advice from Te Akau ‘s racing manager who advised that Mr Kamaruddin had no upcoming riding engagements.

Note: This was later corrected as Mr Kamaruddin did in fact have rides at Rotorua on 28/12/22.

Reasons for Penalty:

Current Penalty Guidelines provide for a 5-day suspension for a second breach in circumstances of three additional strikes.

It was suggested that Mr Kamaruddin seek help from the Riding Mentors in adapting to New Zealand’s whip guidelines. There were no aggravating factors necessitating an uplift.

Accordingly, after consideration of the facts a 5-day suspension is imposed.

Conclusion:

Mr Kamaruddin’s License to ride in races is suspended for 5 days from the conclusion of racing on Wednesday December 28th until the conclusion of racing on Tuesday January 3rd 2023.
