Penalty: Jockey Diego Montes de Oca is suspended for 6 days

Mr Davidson alleged that in Race 4, Mr Montes de Oca angled his mount REINEDELARIVIERE outwards when not sufficiently clear of INTERMINGLE, which was hampered and forced outwards, crowding WEE TADHG near the 250 metres.

Mr Oatham demonstrated on the videos that the Respondent had angled his mount out abruptly at the 250 metres with the Rider of INTERMINGLE, Mr Campbell, having to take hold. WEE TADHG was crowded and had to change ground. The videos show that Mr Montes de Oca was barely a length clear.

Mr Montes de Oca stated he was aware Mr Campbell was there, but he had shifted too abruptly and had caused Mr Campbell to have to check INTERMINGLE.

Decision

As Mr Montes de Oca has admitted the breach, it is found to be proved.

Submissions as to Penalty

Mr Davidson produced the Respondent’s record which showed 6 previous breaches in the past 12 months. He submitted that the breach was low-range and a penalty in accordance with the RIB Penalty Guide of 5+ days was appropriate, with an uplift for the number of previous breaches.

Mr Montes de Oca accepted this .

Reasons for Penalty

Mr Montes de Oca has shifted ground abruptly when not clear of INTERMINGLE. Mr Campbell has had to take hold to avoid REINEDELARIVIERE, and WEE TADHG was crowded and lost ground. The breach is low-range. Mr Montes de Oca has 6 previous breaches of this Rule, although only one in the last 6 months.

Taking a 7-day starting point to reflect record, then a one-day discount for admission of the breach.

Conclusion

Mr Montes de Oca is suspended from riding at the end of the meeting today, up to and including 6 August. This is 6 national days.
