EVIDENCE:
Following the running of Race 2, “Spectators – $15 Daily Deals Handicap Trot”, an Information was filed by Stipendiary Steward Mr V Munro alleging a breach of Rule 869(2) and the Whip and Rein Regulations. The Information alleged: “B Borcoskie (THE BLOSS) used his whip with more than a wrist flicking motion in the home straight”.
Mr Borcoskie signed the Information admitting the breach.
SUBMISSIONS:
The Stipendiary Stewards used the race video to identify Mr Borcoskie driving (12) THE BLOSS, identifying Mr Borcoskie using more than a wrist flicking motion in the home straight.
REASON FOR DECISION:
Mr Borcoskie admitted the breach and the charge was found proved. This was supported by the video evidence.
SUBMISSION FOR PENALTY:
Mr Munro said the Stewards viewed this breach at low range. Mr Borcoskie has a clear record and is a busy Driver.
The Stewards submitted that a $200 fine was appropriate.
REASON FOR PENALTY:
The Penalty Guide has a starting point of $200 for a first offence in the low range. In the circumstances, the Committee find this appropriate.
CONCLUSIONS:
Mr Borcoskie is fined $200.
