Penalty: Driver Stephen McNally's licence to drive is suspended for 2 Days.

EVIDENCE:

Mr Renault played the race video of the start and identified Mr McNally driving SNOW ROBYN who had drawn the pole position. He demonstrated Mr McNally beginning slowly in the mobile event and after a short time ease off the markers to a 2 wide position forcing SPARK IT UP ( Stephen Boyd) wider on the track losing his position.

REASON FOR DECISION:

Mr McNally had admitted the breach and therefore it was proved.

SUBMISSION FOR PENALTY:

Mr Renault submitted Mr McNally drives on average 2 to 3 times a meeting. He said a fine of $250 is usual for a breach of this Rule but there is the aggravating factor of Mr Boyd losing his position early in the race. Mr Renault added Mr McNally had an excellent record and admitted the breach at the earliest opportunity.

Mr McNally stated in his current circumstance he was unable to pay a fine. He said a suspension would be preferred.

REASON FOR PENALTY:

The Adjudicator considered Mr McNally’s request to be suspended rather than fined and this was granted. The Penalty Guidelines for the Push Out Rule provide a $250 fine or a 5 drive suspension as a starting point. In considering all factors a 2 day suspension was thought appropriate in this case.

CONCLUSIONS:

Mr McNally’s licence to drive is suspended for 2 days. Racing days encompassed in this suspension are Friday 15th at Addington and Sunday 17th at Oamaru.
