EVIDENCE:

Following the running of Race 8, Stipendiary Steward Mr Shane Renault presented an Information alleging a breach of Rule 869(7A)(c) by Open Driver Mr John Morrison.

Mr Morrison stated he was conversant with the Rule, the Charge and he confirmed he admitted the breach.

Mr Renault played the video of the first 300m of the race to show Mr Morrison (ULTIMATE COUNSEL) and Mr Hay (ROCKENROLL GRADUATE), drawn 2 and 1 respectively, racing for the lead approaching the first bend. He pointed to Mr Morrison, who was all but clear of Mr Hay, shift inwards, dictating Mr Hay to race inside 2 pylons.

Mr Morrison made no submissions.

DECISION:

The Respondent having admitted the breach, the charge was deemed to be proved.

SUBMISSIONS FOR PENALTY:

Mr Renault stated Mr Morrison had a clear record and with his admission, deserves some credit.

Mr Morrison made no submissions on Penalty.

REASONS FOR PENALTY:

The Penalty Guidelines provide a $300 fine starting point for a breach of this Rule.

Given Mr Morrison’s good record and his frank admission, the Adjudicative Committee consider a $200 fine an appropriate Penalty in the circumstances of this case.

CONCLUSION:

Open Driver Mr John Morrison is fined $200.
