EVIDENCE:

Stipendiary Steward Mr Paul Williams presented an Information alleging a breach of Rule 823(3) by Trainer Jeremy Young before the commencement of Race 7.

The detail of the Information was: “Trainer J Young failed to lodge a Horse Movement Notification form with HRNZ relating to LADY OF THE LIGHT, that horse having been domiciled at Spreydon Lodge since 17 January 2024 as advised on the HRNZ Website on 26 January 2024.”

Mr Williams said this matter is usually dealt with by of the MIN regime but as the horse is competing in a Group 2 Race, an Information was issued.

Mr Young said it was a mistake which he accepts. He said he endeavoured to phone HRNZ without success, and he was under the impression Mr Steven McRae (Spreydon Lodge) had notified HRNZ.

DECISION:

The Respondent having admitted the charge, it was deemed to be proved.

SUBMISSIONS FOR PENALTY:

Mr Williams said the Guidelines provide a $200 fine under the MIN regime but because of the status of the race, this is usually doubled. He said Mr Young has been thoroughly professional since the matter surfaced and the Stewards in taking all factors into account, would accept a $300 fine as an appropriate penalty.

Mr Young said this would be acceptable.

REASONS FOR PENALTY:

The Adjudicative Committee accepts Mr Williams’ submissions as does Mr Young, and finds a $300 fine as appropriate in the circumstances of this case.

CONCLUSION:

Trainer Jeremy Young is fined $300.
