Penalty: Junior Driver Mia Holbrough is suspended for 2 days

EVIDENCE:

Following the running of Race 10, Stipendiary Steward Mr Paul Williams presented an Information alleging a breach of Rule 869(2) by Junior Driver Miss Mia Holbrough.

Miss Holbrough stated she was conversant with the Rule, the charge and confirmed she admitted the breach.

Miss Holbrough was assisted at the hearing by Open Driver Mr Ben Hope.

Mr Williams played the final 300m of the race to identify Miss Holbrough finishing wide on the track and pointed to her striking her horse in a continuous manner. He said all strikes were compliant and with no force, but there were 18.

Miss Holbrough agreed it was a bad look and Mr Hope alluded to Miss Holbrough’s lack of experience.

DECISION:

The Respondent having admitted the breach, the Charge was deemed to be proved.

SUBMISSIONS FOR PENALTY:

Mr Williams said Miss Holbrough was warned for her whip use at Nelson on 14 January, but had a clear record. He said Miss Holbrough would prefer a suspension over a fine and the Stewards had no objection to either a fine or suspension.

Miss Holbrough asked for a deferment if a suspension was to be the penalty, so that she could fulfil an engagement at Waikouaiti on 4 February.

REASONS FOR PENALTY:

The Penalty Guidelines provide a $300 fine or a 2-day suspension for a first breach of the Rule.

Miss Holbrough would prefer a suspension over a fine and this is granted. The breach is at low level and a 2-day suspension is appropriate in this case.

Miss Holbrough’s request for deferment is also granted.

CONCLUSION:

Junior Driver Mia Holbrough’s Licence to drive in races is suspended from 6 February to 9 February 2024 inclusive.
