Summary of Facts:
Following the running of Race 6, the Respondent, Open Driver Robbie Close, admitted a breach of Rule 869(7A)(a) in that when driving ARNOLD LAYNE, he struck a track marker rounding the final bend.
The Respondent endorsed the Information ‘I do admit the breach of the Rule’ .
The Adjudicative Committee excused Mr Close from attending the hearing, as he had horses to attend to at the meeting.
(7A) Every driver who moves inwards shall ensure:
(a) that contact is not made with any track marker
Stipendiary Steward Mr Renault, used available video footage to demonstrate the alleged breach. He showed, using available video replays, Mr Close driving ARNOLD LAYNE rounding the home bend when in contention, and striking a track maker.
Decision:
As Mr Close admitted the breach, the charge is found proved.
Submission For Penalty:
Mr Renault produced the Respondent’s record, which indicated a warning on 14 May 2023 at Ashburton.
Mr Renault stated that the normal penalty for a breach of this Rule was a fine of $100, and submitted a fine commensurate with that be considered as penalty.
Reasons For Penalty:
Having considered all factors, the Adjudicative Committee determined that a $100 fine was an appropriate penalty in this case.
Conclusion:
Mr Close is fined the sum of $100.
