BACKGROUND:

Following the running of Race 8, Future Wealth Sires’ Stakes Aged Trotters Classic Handicap Trot, Open Driver, Bob Butt admitted a charge that, as the Driver of BET N WIN in the race, he contacted a track marker prior to the passing lane.

Rule 869 provides as follows:

(7A)       Every driver who moves inwards shall ensure:

              (a)       that contact is not made with any track marker.

EVIDENCE:

Stipendiary Steward, Shane Renault, showed a video replay of the incident, just prior to the passing lane for the final time. He pointed out BET N WIN, driven by the Respondent, racing in the trail behind the leader, FRANCO JOSIAH. He then showed the Respondent shift in to take the passing lane run and, as he did so, his inside sulky wheel made contact with a track marker.

The Respondent did not wish to comment.

DECISION:

The charge having been admitted, it is deemed proved.

SUBMISSIONS FOR PENALTY:

Mr Renault said that a breach of the Rule is normally dealt with by way of a fine of $100 under the Minor Infringement scheme. However, the race being a Listed Race for a stake of $40,000, Mr Renault said that an Information had been filed, and Stewards were seeking a fine of $200.

REASONS FOR PENALTY:

A breach of the Rule is normally dealt with as a Minor Infringement and a fine of $100. Some recognition must be made of the status of the race and the stake payable and, accordingly, a fine of $200 is imposed.

CONCLUSION:

Open Driver, Bob Butt, is fined $200.
