Penalty: Amateur Driver Alan Edge is fined $300

EVIDENCE:

Following the running of Race 1, Amateur Driver Mr Alan Edge faced a charge of careless driving in that he contacted the sulky wheel of PROVISEUR near the 1300 metres. The video evidence of the incident is clear and compelling, so much so Mr Edge asked for it not to be shown to the Committee.

REASON FOR DECISION:

Mr Edge has admitted the breach and therefore the charge is proved.

SUBMISSION FOR PENALTY:

Mr Ydgren submitted the breach had an aggravating factor which was the affected horse, PROVISEUR, had to be pulled out of the race on the final bend. He said in mitigation Mr Edge has admitted the breach at the earliest opportunity, has not breached this particular Rule before and, has been a model  Respondent. He submitted a fine of $300 would be an appropriate penalty.

REASON FOR PENALTY:

Mr Edge has acknowledged his carelessness and the Committee appreciate his brutal honesty. The Committee in considering all factors find a $300 fine as an appropriate penalty in this case.

CONCLUSIONS:

Mr Edge is fined $300.
